These Terms & Conditions (“Terms”) govern your use of HouseForCash.com (the “Website”) and your interactions with House For Cash, LLC relating to the Website and any property inquiry submitted through it.

Please read these Terms carefully. By using the Website, submitting information, requesting an offer, or otherwise using our Website-related services, you agree to these Terms.

1. Definitions

“House For Cash,” “we,” “us,” and “our” mean House For Cash, LLC, a Florida limited liability company.

“Affiliate” means a separate legal entity under common ownership or control with House For Cash. An Affiliate is not included within the terms “House For Cash,” “we,” “us,” or “our.”

“Property Inquiry” means information you provide regarding a property, including a request for an offer, property evaluation, sale discussion, or other real-estate-related assistance.

“Seller,” “you,” and “your” mean the person using the Website or providing information regarding a property.

2. Our Services

House For Cash is a real estate investment and property-acquisition company.

Through the Website and related communications, House For Cash may:

receive and review Property Inquiries;
evaluate properties and potential acquisitions;
communicate with property owners and authorized representatives;
discuss possible purchase terms or other solutions;
make or facilitate purchase proposals;
conduct due diligence;
enter into purchase agreements;
acquire properties directly or through Affiliates or permitted assignees; and
when appropriate, refer a Property Inquiry to another investor, real estate professional, or service provider as described in these Terms.

Submitting a Property Inquiry does not require you to sell your property and does not require House For Cash or any Affiliate to make an offer or purchase the property.

3. Affiliated Acquisition Entities

House For Cash may use separately organized Affiliates to acquire, finance, own, renovate, manage, sell, or otherwise participate in real estate transactions.

An Affiliate is a separate legal entity and is responsible for its own contracts, obligations, conduct, assets, and liabilities.

House For Cash’s involvement in marketing, communications, negotiation, due diligence, or transaction coordination does not by itself make House For Cash responsible for the contractual obligations of an Affiliate.

The identity of the legal Buyer in any particular transaction will be determined by the applicable purchase agreement, assignment, closing documents, or other transaction documents.

4. Purchase Agreements and Contractual Interests

Any purchase and sale agreement is a separate contract.

The purchase agreement, and not these Website Terms, governs matters including:

purchase price;
deposits;
inspection and due-diligence rights;
title matters;
closing;
assignment or designation rights;
defaults;
remedies;
extensions;
specific performance; and
the identity and obligations of the Buyer.

Where permitted by the applicable purchase agreement and law, House For Cash or a Buyer may assign, sell, transfer, designate, or otherwise dispose of contractual purchase rights to an Affiliate, investor, acquisition entity, funding or investment partner, or other permitted assignee.

House For Cash or another Buyer may receive compensation or earn a profit from the acquisition, assignment, transfer, renovation, financing, resale, or other disposition of real estate or contractual rights.

Nothing in these Terms modifies a separately executed purchase and sale agreement.

5. No Brokerage or Agency Relationship

Unless expressly stated in a separate written agreement, House For Cash is acting as a potential real estate purchaser or investment company and not as your real estate broker, agent, fiduciary, attorney, financial adviser, or tax adviser.

House For Cash does not represent you in determining whether a proposed transaction is in your best interests.

You may consult your own attorney, real estate professional, accountant, financial adviser, or other professional before entering into a transaction.

6. No Guaranteed Offer or Market Value

Submitting information does not guarantee that House For Cash or an Affiliate will make an offer.

Any offer may take into consideration factors including property condition, location, market conditions, estimated repairs, financing, holding costs, resale considerations, title matters, occupancy, and other circumstances.

An offer from House For Cash or an Affiliate is not an appraisal and may differ from the amount you might receive through a traditional real estate listing or another method of sale.

You are free to accept, reject, or seek alternatives to any offer.

7. Communications, Property Visits, and Opt-Out Rights

When you provide your telephone number, email address, mailing address, property address, or other contact information, you authorize House For Cash to contact you regarding your Property Inquiry and related real estate matters.

Contact may include:

telephone calls;
text messages;
emails;
mail; and
an in-person visit to the property address you provide, including knocking on the door for purposes of following up on your Property Inquiry, discussing a potential transaction, gathering information, or attempting to reach you.

An in-person visit does not authorize House For Cash to enter your home, dwelling, structure, fenced area, restricted area, or other non-public portion of the property without separate permission.

If you ask House For Cash not to visit the property, we will honor that request.

Where House For Cash uses automated technology, artificial or prerecorded voice communications, automated text messaging, or other communication methods requiring special consent under applicable law, House For Cash will obtain any consent required by applicable law before using those methods.

You may ask us to stop calling, texting, emailing, mailing, or visiting you. You may also reply STOP to an applicable text message.

8. Call Recording

Telephone conversations may be recorded when permitted by applicable law and after obtaining any consent required by applicable law.

Nothing in these Terms constitutes advance consent to recording where separate or contemporaneous consent is required.

9. Referrals to Other Investors, Real Estate Professionals, and Service Providers

House For Cash’s primary purpose in receiving a Property Inquiry is to evaluate whether House For Cash or an Affiliate may be interested in acquiring the property or otherwise assisting with the inquiry.

We may determine that House For Cash or an Affiliate is not the best fit for your situation, or that another investor, real estate professional, or service provider may be better able to assist you.

By submitting a Property Inquiry and accepting these Terms, you authorize House For Cash, when we reasonably believe it may help address your Property Inquiry, to discuss your inquiry with and provide relevant information to one or more potential referral recipients for the purpose of determining whether they may be able to assist you.

Potential referral recipients may include:

real estate investors or buyers;
real estate brokers or agents;
attorneys or other professional advisers;
property-related service providers; or
other professionals reasonably related to your Property Inquiry.

If an appropriate referral is identified, House For Cash may introduce you to or refer you to that person or company, and that referral recipient may contact you regarding the Property Inquiry, subject to applicable law.

This authorization is limited to referrals reasonably related to your Property Inquiry. It does not authorize unrelated third parties to use your information for unrelated products or services.

A referral recipient is a separate person or entity and is responsible for its own services, communications, conduct, representations, contracts, and legal compliance.

House For Cash does not guarantee that a referral recipient will make an offer, accept a property, provide a particular service, or achieve any particular result.

You may tell House For Cash at any time that you do not want your Property Inquiry referred to unrelated third parties.

Nothing in this Section prevents House For Cash from sharing information with an Affiliate, title company, closing professional, lender, funding source, inspector, contractor, service provider, or other permitted transaction participant when reasonably necessary to evaluate, finance, administer, or complete a transaction involving House For Cash or an Affiliate.

10. Privacy

Our collection, use, retention, and disclosure of personal information are described more fully in our Privacy Policy.

Information may be used or disclosed as reasonably necessary to:

evaluate your Property Inquiry;
communicate with you;
evaluate or complete a potential acquisition;
conduct due diligence;
work with Affiliates;
obtain financing or funding;
work with title and closing professionals;
obtain property-related services;
comply with legal obligations; and
make a referral permitted by Section 9.

The Privacy Policy is incorporated into these Terms by reference.

11. Accuracy and Authority to Provide Information

You agree to provide information that is accurate to the best of your knowledge.

If you submit information regarding a property, you represent that you are the property owner or are otherwise authorized to provide the information and communicate regarding the property.

You agree not to knowingly submit false, fraudulent, misleading, or unauthorized information.

12. Website Content

Website content is provided for general informational purposes.

Although we attempt to maintain useful and accurate information, we do not guarantee that every statement, estimate, article, calculator, property value, market statement, or other Website content will always be complete, current, or error-free.

Website information is not legal, tax, financial, brokerage, appraisal, or other professional advice.

13. Intellectual Property

Unless otherwise stated, the Website and its content, including text, graphics, logos, photographs, videos, designs, software, and other materials, are owned by or licensed to House For Cash.

You may not reproduce, distribute, modify, publish, sell, exploit, or use Website content for commercial purposes without permission.

House For Cash™ is a trademark of House For Cash, LLC. A United States trademark application is pending.

14. Information and Materials You Submit

You authorize House For Cash to use information, photographs, documents, property details, communications, and other materials you voluntarily provide for purposes reasonably related to your Property Inquiry.

This may include sharing relevant materials with:

Affiliates;
title and closing professionals;
lenders and funding sources;
inspectors and contractors;
service providers;
other transaction participants; and
potential referral recipients as permitted by Section 9.

You represent that you have the right to provide materials you submit.

15. Third-Party Websites and Services

The Website may contain links to third-party websites, platforms, applications, or services.

House For Cash does not control those third parties and is not responsible for their content, privacy practices, security, representations, or services.

Your interactions with a third party may be governed by that third party’s own terms and privacy policies.

16. Website Availability

We do not guarantee uninterrupted or error-free Website availability.

We may change, suspend, restrict, or discontinue any portion of the Website at any time.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Website and Website-related services are provided on an “as is” and “as available” basis.

House For Cash disclaims warranties that are not expressly stated in a separate written agreement.

Nothing in this Section eliminates warranties or rights that cannot lawfully be waived.

18. Limitation of Liability

To the fullest extent permitted by applicable law, House For Cash will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from your use of the Website or Website-related services.

For claims arising solely from the Website or these Terms, House For Cash’s aggregate liability will not exceed the greater of:

the amount, if any, you paid House For Cash for the applicable Website-related service during the six months preceding the event giving rise to the claim; or
$500.

This limitation does not apply where prohibited by law.

Any liabilities, damages, obligations, or remedies arising under a separately executed real estate purchase and sale agreement are governed by that agreement and are not limited by this Section unless the purchase agreement expressly provides otherwise.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold House For Cash harmless from third-party claims arising from information or materials you knowingly submit without authorization, your unlawful use of the Website, or your material violation of these Terms.

This provision does not require you to indemnify House For Cash for House For Cash’s own fraud, willful misconduct, or liability that cannot lawfully be shifted to you.

20. Arbitration and Class Action Waiver

Except for matters excluded below, you and House For Cash agree that claims arising out of or relating to the Website, Website-related services, marketing, communications, privacy practices, or these Terms will be resolved by binding individual arbitration rather than in court.

Arbitration will be administered by the American Arbitration Association under the applicable consumer arbitration rules unless the parties agree otherwise.

The arbitration will be conducted before one neutral arbitrator.

Claims must be brought individually. Neither party may bring or participate in a class action, class arbitration, representative action, or consolidated proceeding except where such restriction is prohibited by law.

Either party may bring an eligible claim in small claims court.

Either party may also seek temporary or preliminary injunctive relief from a court when reasonably necessary to preserve rights or prevent immediate harm while arbitration is pending.

To the fullest extent permitted by law, you and House For Cash waive trial by jury for claims covered by this arbitration provision.

For purposes of claims concerning the Website, House For Cash’s marketing or communications, privacy practices, or these Terms, House For Cash’s current and former officers, managers, members, employees, agents, representatives, contractors, service providers, insurers, successors, and assigns may enforce this arbitration provision when the claim against them arises from their relationship with House For Cash.

An Affiliate may enforce this arbitration provision only for a claim arising from the Website, House For Cash’s marketing or communications, privacy practices, or these Terms.

An Affiliate may not use this provision to avoid obligations or remedies belonging to a Buyer under a separately executed purchase and sale agreement.

Nothing in this Section makes these Website Terms the dispute-resolution agreement for a separately executed real estate purchase and sale agreement.

21. Governing Law and Venue

Except where federal law applies or applicable consumer law requires otherwise, these Terms and any dispute arising out of or relating to these Terms, the Website, or House For Cash’s Website-related services will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

For any dispute that is not required to be resolved through arbitration under Section 20, and subject to any mandatory venue rights or requirements that cannot lawfully be waived, any lawsuit, action, or proceeding arising out of or relating to these Terms, the Website, or House For Cash’s Website-related services shall be brought exclusively in the appropriate state court located in Orange County, Florida, or, where federal subject-matter jurisdiction exists, in the United States District Court having jurisdiction over Orange County, Florida.

You and House For Cash consent to the personal jurisdiction of those courts and waive any objection to venue in those courts to the fullest extent permitted by law.

For clarity, this Section governs disputes concerning the Website and these Terms and does not determine venue for disputes arising under a separately executed real-estate purchase and sale agreement. Venue for any such real-estate transaction dispute will be governed by the applicable purchase agreement.

22. Changes to These Terms

We may update these Terms from time to time.

The “Last Updated” date identifies the most recent revision.

Changes will apply prospectively unless applicable law permits otherwise.

23. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

24. No Waiver

Failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

25. Entire Website Agreement

These Terms and the Privacy Policy constitute the agreement between you and House For Cash concerning the Website and Website-related services.

They do not replace or modify a separately executed purchase agreement or other written transaction agreement.
